Navigating Vape Regulatory Changes

The vaping industry was once uncharted territory, like every other industry at its inception. However, it has rapidly evolved in recent years, with its growth driven by innovation and shifting customer preferences. Alongside this growth there has emerged an increasingly complex regulatory landscape, with vape manufacturers being mandated to navigate the requirements. This article serves as a guide for vape manufacturers, both established and emerging, to understand and successfully navigate the ever-changing world of vape regulations.

Factors to Note about Vaping Regulations

Compliance with federal regulations is a non-negotiable aspect of operating a vape manufacturing business. In this section, we provide an overview of the various factors that vaping manufacturers must consider to ensure that they don’t overstep the law by failing to protect consumers.

  1. California Proposition 215: This was the first modern law legalizing the use of cannabis for medical purposes in the United States. Other states drew upon the work done in California to pass their own legislation on the medical and recreational use of cannabis. Today, the majority of US states have either legalized certain uses of marijuana or at least, decriminalized its use. It’s important for manufacturers and retailers to be conscious of state law when dealing in cannabis.
  2. Food and Drug Administration: this is the federal agency in charge of cannabis regulation in the US. Its current stance is that cannabis and its extracts such as THC and CBD are considered controlled substances. So, they cannot be marketed as dietary supplements or added to food. Particularly, the FDA warns against marketers making false claims about their cannabis products. This is crucial for manufacturers and retailers as well in order to ensure that they are not misleading potential buyers.
  3. The Cannabis Act of Canada: this Canadian federal law came into effect in 2018 and regulates the production of cannabis across the country. While legalizing sale of cannabis extracts and vaping products, particularly, it prohibits the use of harmful substances in making cannabis extracts, including vaping products. Such products cannot contain sugars and sweetening agents, caffeine, nicotine, ethyl alcohol, etc. As such, Aveo vaping products are not designed with e-juice or any other kind of tobacco-derived substances.
  4. Record-keeping and Documentation: In the US and Canada, license holders are required to maintain records related to their products, containing information on the ingredients used, as well as the reports of analytical tests conducted to certify the safety of their products. Aveo is fully compliant with these requirements and these records are available to anyone who requires it. All you have to do is send us a request via email.
  5. Age Verification: In the US, the legal age for purchasing vaping products is twenty-one. However, the bulk of the penalty goes to retailers and suppliers who sell to underage customers. As a manufacturer, you have to be wary of partnering with businesses that break the law in this manner.

Staying On Top of Regulatory Changes

Like all regulations, vaping regulations are not a permanent fixture. And even where vaping is widely acceptable, the practical details of the laws regulating it may be adjusted from time to time. How can vaping manufacturers ensure that they are in line with the current legislation?

  • Conduct internal audits to ensure ongoing compliance with current regulations. An audit will help you identify existing gaps between your current processes and regulatory requirements. It also ensures that you don’t wait until you are sanctioned by a regulatory agency before making amends.

  • Engage with industry associations and other players in the field to stay on top of updates. Although some of the players might be your competitors, engaging them can have its own benefits too. On the other hand, isolating your business means closing yourself to useful information.

  • Establish a compliance team of legal practitioners and quality control experts to monitor regulatory changes in the industry and develop plans for meeting new requirements whenever they come up. Never be kept in the dark about anything.

How Aveo Navigates Compliance and Takes Responsibility

At Aveo, standards are a big deal, and we treat them as such. Therefore, we take responsibility for being proactive, not just in meeting the minimum compliance requirements but also going over to ensure that our end consumers are safe. This is why we have remained the manufacturer of choice for many vaping device suppliers in the United States and Canada. Let’s explore some of the factors that distinguish us from other manufacturers.

  1. Reputation and Reliability

When it comes to upholding standards, nothing beats a team with experience. When we started in 2014, our focus was mainly on distribution, cultivation, and oil extraction. We have since evolved, and the quality of our in-house experience keeps us going. The team is composed of members with in-depth knowledge of the practical details of vaping regulation. We have experienced the industry’s development from a completely gray market into one where regulations started springing forth as permissions expanded. In essence, this is a team that is well-versed in vaping regulations, and we have persevered all these years by avoiding crossing boundaries, not only out of a commitment to following the law but also because we prioritize the safety of our end consumers above all else.

  1. Certifications

We have obtained certifications in the United States and Canada, demonstrating our commitment to upholding the standards set in both countries. Some of these certifications are GMP 820 (good manufacturing practice requirements), ISO 114001:2015 (environmental management system), ISO 45001:2015 (occupational health and safety), and ISO 9001:2015 (quality management system), ISO 13485 (medical devices), among others. Upon demand, we can provide our Material Safety Data Sheets (MSDS), FDA food contact material test results, and other relevant certifications. The full spec sheets for our cartridge and disposable products are available on our website, or you can contact our team to obtain them.

  1. Quality Control

The safety of the end consumers is our priority at Aveo, and we go the extra mile in upholding the highest standards. All materials we use comply with the FDA’s rules and regulations, especially for equipment and parts that come in direct contact with the oil or the customer. Also, each component in our cartridges undergoes food-grade standard testing. More so, our team is composed of rigorously trained industry experts who possess a deep understanding of safety requirements, quality standards, and consumer needs.

  1. Safety

All our products are free of heavy metals. At Aveo, there is a rigorous testing protocol in place, particularly for our cartridges, since they are the parts that come into direct contact with the oil. Through that, we ensure that our cartridges do not contain heavy metals that may be harmful to the body. In addition, Aveo’s cartridges feature a ceramic core that embeds the heating coil. This ensures that the coil does not come into contact with the oil and is also another way by which we maintain the safety of our vaping devices, putting consumers first.

  1. Environmental Sustainability

In recent years, the continued sustainability of our planet has shifted to the forefront of global discourse as concerns over environmental degradation have risen. These concerns have led to the increasing development of regulations surrounding environmental sustainability. At Aveo, we like to stay proactive. Therefore, this is one aspect of safety that we take highly seriously. We have started ensuring a massive reduction in petroleum-based plastic use throughout our supply chains. Instead, we opt for hemp-plastic blends, which create a biodegradable plastic that degrades in only a couple of years, unlike traditional plastics. Through this, we have reduced our plastic use by 25%, with commitments for future enhancements. More so, we have also eliminated printed circuit boards (PCBs) in our products and reduced the size of plastic cells, all in a bid to make a meaningful contribution to climate action on our planet.

Compliance not only upholds the law but also fosters consumer trust and industry credibility. When a manufacturing business recognizes this fact, it becomes easy to submit to fair compliance standards. Ultimately, it’s all about the consumer. This is our mantra at Aveo, and it has helped us remain on the right side of the law for about a decade. It is also why our partners maintain huge trust in our brand!
